Welcome to Classy Mandarin! These Terms of Service ("Terms") constitute a binding legal agreement between you ("User," "you," or "your") and Classy Mandarin (referred to as "we," "us," or "our"). These Terms outline your rights and responsibilities when accessing, purchasing, and utilising our online courses, digital downloads, newsletter, and live coaching services (collectively, the "Services").

By accessing, purchasing, or using any of our Services, you expressly agree to be bound by these Terms.

1. The Basics of Our Agreement

A. Who We Are

You are entering into an agreement with Classy Mandarin.

B. Your Agreement

These Terms are a binding legal contract that commences upon your first use of our website or purchase of any Service.

2. Your Course & Digital Products License (Intellectual Property)

This section is extremely important. All materials are protected intellectual property and are owned exclusively by Classy Mandarin.

A. What You Get (Personal Use Only)

When you purchase a course, live session, or digital download (e.g., e-books, video lessons), you are granted a limited, non-transferable, non-exclusive license to use the materials for your own personal, non-commercial learning purposes only.

B. What You Must NOT Do

Unauthorized use is strictly prohibited. You may not, without our explicit prior written permission:

• Share or Distribute: Give, share, sell, rent, sublicense, or post our courses, videos, e-books, or any part of our materials to anyone else (including friends, family, or online forums).

• Commercial Use: Use our materials for any business purpose, public performance, or to teach or train others.

• Modify: Change, translate, reverse engineer, or create derivative works from our content.

• Remove Notices: Take off any copyright, trademark, or proprietary notices from the materials.

Violation of these IP terms will result in the immediate and permanent termination of your access to all Services without a refund, and may lead to legal action.

3. Our Non-Refundable Policy

Due to the digital nature and immediate access provided by our products and services, all sales are final.

• Digital Products: We do not offer refunds on digital downloads (e-books, audio files, video lessons) or paid course access.

• Coaching Services: Once an online coaching session or package has been utilized, delivered, or commenced, the associated payment becomes non-refundable.

• Technical Issues: If you experience a technical issue preventing proper access or download, we will work diligently to provide a working replacement or technical solution at our discretion.

By purchasing, you acknowledge and agree to this definitive non-refundable policy. Please review the course and service details carefully before you buy.

4. Specific Rules for Online Coaching

A. Scheduling & Cancellations

• Booking: Online Live Sessions must be scheduled at least 48 hours in advance.

• Rescheduling/Cancellation Policy: You must provide a minimum of 24 hours' notice via email (contact@classymandarin.com) or the booking system to reschedule or cancel a session.

• Forfeiture: Failure to give timely notice will result in the forfeiture of the scheduled session, and no credit or refund will be issued for that time slot.

B. Participant Conduct

You agree to communicate and participate in all coaching sessions professionally and respectfully. We reserve the right to immediately suspend or terminate your access to coaching services (without refund) if your conduct is abusive, offensive, harassing, disruptive, or inappropriate.

5. Disclaimers and Limitation of Liability (CRITICAL)

A. Professional Advice Disclaimer

The content, lessons, and materials provided by Classy Mandarin are for informational and educational purposes only. They are not intended to be a substitute for professional linguistic advice, formal academic instruction, or other specialized professional guidance. You are solely responsible for how you use the information provided.

B. No Guarantee of Results

We provide high-quality materials and instruction, but we do not guarantee that you will achieve any specific level of Chinese fluency, proficiency score, or any other specific outcome. Individual learning results vary significantly based on effort, consistency, dedication, and individual background.

C. Limitation of Warranty (As-Is Services)

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." We make no warranties, express or implied, regarding the Services, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

D. Limit of Our Financial Responsibility

If you have a claim against us related to our Services, our total financial liability to you, under any circumstances, will not exceed the amount you paid to us for the specific product or service that caused the claim in the twelve (12) months preceding the claim. We are not responsible for any indirect, incidental, consequential, special, punitive, or exemplary damages (including but not limited to loss of profits, data, or business interruption).

6. Governing Law and Disputes

A. Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles.

B. Resolving Disputes

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of our Services will be subject to the exclusive jurisdiction of the courts located in Ghent, Belgium.

A. Modifications to Terms

We may update these Terms at any time. We will post the revised version on this page, and the changes will be effective immediately upon posting. Your continued use of our Services after the updated Terms are posted means you accept and agree to the revised Terms.
